1. How it works.
Yobbo's service is available on the website https://yobbo.es/ and is a web-based service that helps individuals and companies ("users") find service companies that perform crafts, cleaning, removals, etc. ("companies"). As a user, it is always free to use Yobbo and you are never obligated to choose any of the companies you come into contact with via Yobbo.
When users submit a request on Yobbo, it is sent to matching companies that are given the opportunity to respond to the request. Once the company has received the user's contact information, it is up to these two parties to proceed with their procurement.
2. Personal data and privacy policy
Yobbo is the data controller and manages the User's personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable legislation. The User's contact information is used to enable Yobbo to fulfill its contractual obligations towards the User. The User agrees that Yobbo will forward the User's contact information to the companies that choose to respond to a request for quotation. Yobbo will also use the User's email address and/or Whatsapp to administer the sending of newsletters and other information. The User has the opportunity to take part in Yobbo's processing of his/her data.
3. Affiliated companies
Yobbo has affiliated companies that provide services in a large number of areas divided into different categories. To help users of Yobbo find safe companies, we set requirements for all companies that want to join the service.
4. Yobbo's disclaimer
Yobbo is not a party or legal entity to the business agreements concluded between users and companies. This means that Yobbo is not responsible for any disputes that may arise between users and companies, such as misunderstandings in contracts, disagreements regarding work, damage or non-payment.
The user has no right to claim compensation from Yobbo for financial or other damage, as a result of circumstances that can be traced to Yobbo.es, such as incorrect information, inadequately performed work or suspension from Yobbo.
5. Requests on Yobbo.es.
There is no designated publisher on Yobbo and each user who chooses to make a request on Yobbo.es is personally liable for the material. The material must not be misleading and must otherwise comply with Spanish law and applicable regulations.
Users must behave professionally and with care on Yobbo.es, which means, among other things, that offensive and insulting material must not be published on Yobbo.es. The material that users publish on Yobbo.es must not be disloyal to the activities that Yobbo conducts. Abuse of the functions on Yobbo.es is strictly prohibited, including attempting to break security barriers, spreading viruses, using other people's login details or in various ways disrupting the use of Yobbo.es by other users or companies.
In cases where users take actions with the aim of degrading Yobbo's service, destroying Yobbo's reputation or misleading Yobbo's company by, for example, making repeated requests, making requests as a company with the aim of comparing prices for their own company's service or creating several different users and making requests without interest in hiring a company, Yobbo has the right, in addition to suspending the user, to obtain from the user damages corresponding to a price base amount according to the General Insurance Act or, if the damage is greater than that, the amount at which the damage is calculated. Users are obliged to take reasonable measures to search for and remove viruses or other things that have destructive properties, before transferring material to Yobbo.
6. Information on Yobbo.es
Yobbo actively works to ensure that the information published on Yobbo.es is accurate but cannot guarantee this. Users do not have the right to make financial claims against Yobbo in cases where there is material on Yobbo.es that is not accurate.
7. Liberating circumstances
Yobbo is exempt from penalties for failure to fulfill a certain obligation if the failure is based on a so-called extenuating circumstance. Extenuating circumstances shall be considered to include, among other things, an action or omission by an authority, new or amended legislation, staff resignation, illness or other impairment of working capacity, death, labor market conflict, blockade, fire, flood, loss or destruction of data or property of significant importance or an accident of major magnitude.
8. Intellectual property rights
Yobbo owns the right to use texts, logos, images and other material published by users on Yobbo.es. However, ownership of these intellectual property rights remains with the user. Other material, such as texts, graphics, images and logos found on Yobbo.es is owned by Yobbo and is protected by copyright law and other intellectual property laws such as trademark law. Furthermore, the Yobbo.es database as such is protected by copyright law.
9. Sanctions
Yobbo reserves the right, without giving reasons, to suspend users who violate Spanish law or who otherwise do not comply with these general terms and conditions. Yobbo reserves the right to refuse publication or remove published material if it is perceived as offensive or inappropriate in relation to the activities carried out by Yobbo.
In the event of minor violations of these rules, a warning will be issued. In the event of repeated violations or serious violations of the rules, the user may be suspended with immediate effect.
If the information published by a user on Yobbo,es should lead to liability for damages for Yobbo, the user is obliged to indemnify Yobbo or compensate Yobbo for the damage incurred.
10. Changes
Yobbo has the right to change these general terms and conditions without prior notice, either on its own initiative or if required by law or regulation. Users are encouraged to review these general terms and conditions on an ongoing basis.
11. Applicable law – Dispute
Disputes arising from these terms of use shall be settled in the general Spanish courts of first instance. Spanish law shall apply.
Terms of use - Companies that wants to perform the jobs
1. The service provider Yobbo.es
Yobbo's service is available on the website https://yobbo.es and is a web-based service that helps individuals and legal entities (“Users”) find service companies in the form of suppliers of craft services, cleaning services, etc. The service companies are referred to below as Yobbo's “Customer(s)”.
2. Basic requirements
The Agreement applies to you and the company/organization you are authorized to represent. As an authorized signatory, you guarantee that you have the right to enter into agreements for the company/organization you represent. The Agreement becomes binding on the Customer by signing the general terms and conditions (physically or electronically in a manner that Yobbo instructs).
The Customer further undertakes to comply with applicable laws and regulations when performing services for the Users and to otherwise perform its services in a professional manner.
Yobbo continuously checks that the Customers meet Yobbo's basic requirements. If the Customer does not meet all of the above basic requirements, Yobbo has the right to immediately suspend the Customer's ability to respond to inquiries from the Users. Being a Customer with Yobbo means that we process the personal data of the Customer and, where applicable, the Customer's representative.
3. Customer inquiries and users' contact information
Yobbo only provides Users' contact information to Customers who choose to respond to an inquiry. Customers may not sell, forward or in any way forward Users' contact information. Thus, information may not be forwarded to, for example, services that compete with Yobbo.es. However, Customers may, after the User in question has engaged the Customer, forward the User's contact information to a subcontractor engaged by the Customer.
4. Cancellation of the contract or complaint about the assignment.
In cases where the Customer in any way abuses or mishandles its obligations in accordance with this agreement, e.g. abuses the Users' contact information, Yobbo has the right to immediately suspend the Customer's access to the service.
In cases where connected Customers take actions that are intended to impair Yobbo's service, forward information in violation of paragraph 4, destroy Yobbo's reputation or otherwise act disloyally towards Yobbo, Yobbo has the right, in addition to terminating this agreement, to receive from the Customer damages equivalent to five (5) price base amounts according to the General Insurance Act or, if the damage is greater than that, the amount of the damage.
In the event of a complaint about an assignment, special conditions apply in accordance with Yobbo's requirements. In the event of a complaint about an assignment approved by Yobbo, what the Customer has paid in Yobbo credits will be refunded. This refund policy also applies in cases where the Customer has paid in Euro. Regarding complaints in general, customary sales law rules apply.
5. Personal data
Each party is obliged to comply with the EU General Data Protection Regulation (GDPR) and other applicable legislation regarding the protection of personal data. Yobbo processes the personal data of Users who use Yobbo.es and Yobbo is to be considered as the data controller in relation to these Users.
When Yobbo transfers a User's personal data to the Customer, the following applies. The Customer is to be considered as the Data Controller for the User's personal data. In short, this means that the Customer, when processing the User's personal data, has a responsibility to comply with the GDPR and other applicable legislation.
In order to be able to fulfill Yobbo's contractual obligations towards the Customer, the personal data that the Customer or the Customer's representative provides to Yobbo when registering a user account, such as name, address and email address, is processed. For this information, Yobbo is to be considered as the data controller.
As a Customer at Yobbo, the Customer's company details, and where applicable those of its representatives, will be published on Yobbo.es as this is a central and necessary part of the execution of the agreement. Regarding representatives of the Customer, publication is instead based on a balance of interests. Where applicable, user reviews are also published. The Customer further understands that Users, Yobbo, group companies and its partners may contact the Customer via letter, telephone, email, Whatsapp and SMS.
More information about Yobbo's processing of the Customer's and Customer's representatives' personal data, data subject rights, etc. can be found in Yobbo's privacy policy.
6. Force Majeure
The parties are exempt from penalties for failure to fulfill a certain obligation under this Agreement, if the failure is based on a so-called extenuating circumstance of material importance.
An extenuating circumstance shall be considered under this agreement, for example, an official action or omission, new or amended legislation, a conflict in the labor market, a blockade, a fire, a flood, a loss or destruction of data or property of material importance or an accident of major importance. If a party wishes to invoke exemption under an extenuating ground of liability, the party shall notify the other party thereof without undue delay in order to be able to invoke the circumstance.
7. Limitation of liability
In the event that the Yobbo.es website or the application is not in use or cannot be used fully due to circumstances such as the server or other technical necessity being out of order, the website being subject to sabotage by third parties or other circumstances over which Yobbo is wholly or partially unable to control, the Customer shall not be entitled to claim a price reduction.
Yobbo is not a party to the business agreements entered into between Users and Customers. Yobbo is therefore not to be considered as any form of legal intermediary between Users and Customers. This means that Yobbo shall not be liable for any disputes that may arise between Users and Customers, e.g. concerning deficiencies in work performed, damage, errors or non-payment.
The parties' liability under this Agreement is limited to direct damages. Yobbo's liability for damages is under all circumstances limited to an amount corresponding to the sum of what the Customer has paid in compensation to Yobbo during the next three months, however, a maximum amount corresponding to a price base amount according to the General Insurance Act.
8. Intellectual property rights
Yobbo owns the right to use texts, logos, images and other material published by the Customer on Yobbo.es. However, the ownership of these intellectual property rights remains with the Customer or its partners. Other material, such as texts, graphics, images and logos found on Yobbo.es is owned by Yobbo and is protected by copyright law and other intellectual property laws such as trademark law. Furthermore, the Yobbo.es database as such is protected by copyright law.
9. Insolvency of party
A party has the right to terminate this agreement if the other party is declared bankrupt, enters into composition negotiations, enters into liquidation or can otherwise be assumed to have become insolvent.
10. Transfer
The Customer may not, in whole or in part, assign or pledge its rights and/or obligations under this Agreement without Yobbo's written consent.
11. Messages
The Customer shall notify Yobbo of updated address and contact details in the event of any change. Notices regarding such details or other types of communications between the parties in connection with this Agreement shall be sent by courier or registered letter or email to the parties' addresses specified in the Customer Agreement or as subsequently changed.
12. Changes and additions
Amendments and additions to the Customer Agreement must be in writing and approved by Yobbo in order to be binding. However, Yobbo has the right to make amendments or additions to these General Terms and Conditions on its own initiative and to unilaterally terminate the service without giving reasons. If the Customer objects to this because it entails a significant disadvantage for the Customer, they must notify Yobbo of this no later than 14 days after it comes into force. Notification can be made via email or through information in the Customer's user account.
13. Cookies
Yobbo.es uses cookies when you visit the site. Cookies are information files that are placed on your computer. Yobbo.es primarily uses cookies to enable you to use Yobbo.es in the best possible way. The cookie does not identify you personally, but rather the browser installed on the computer you are using. The cookie does not contain viruses and cannot destroy other information on your computer. You have the right to opt out of cookies in your browser, but then you cannot use all the services on Yobbo.es to their full extent.
14. Event of dispute and choice of law
Disputes between the parties arising from this Agreement shall be settled in a public court and with the application of Spanish law.
